MACRO PUMP TERMS OF USE AND END USER LICENSE AGREEMENT

Effective Date: October 1, 2026
Last Updated: October 1, 2026

These Terms of Use and End User License Agreement ("Terms") form a legally binding agreement between you and Six Side Marketing, doing business as Macro Pump ("Macro Pump," "we," "us," or "our").

These Terms govern your access to and use of the Macro Pump application, Pump Buddy, Coach Mode, subscriptions, content, communications, services, and related functionality.

By creating an account or using Macro Pump, you agree to these Terms and acknowledge the Macro Pump Privacy Policy.

If you do not agree, do not use Macro Pump.

30.1 Eligibility

You must be at least 13 years old to create or use a Macro Pump account.

If you are under the age of majority in your jurisdiction (commonly 18), you may only use Macro Pump with the consent and involvement of a parent or legal guardian. By permitting a minor to use Macro Pump, that parent or legal guardian agrees to be bound by these Terms on the minor's behalf, accepts responsibility for the minor's use of the app, and agrees to supervise any coaching relationship the minor forms through Coach Mode.

You may not use Macro Pump on behalf of another person unless you have lawful authority to do so.

30.2 The Macro Pump Service

Macro Pump provides fitness, nutrition, workout, calorie and macronutrient tracking, food logging, water tracking, weight tracking, goals, Apple Health step functionality, progress information, workout planning, artificial-intelligence-assisted functionality, Coach Mode, coach-client messaging, workout assignment, and related services.

Features may be added, modified, restricted, replaced, or discontinued subject to applicable law.

30.3 Macro Pump Is Not Medical Care

Macro Pump is a fitness and wellness application.

Macro Pump is not a physician, hospital, medical clinic, registered dietitian, physiotherapist, psychologist, emergency service, or other healthcare provider.

Macro Pump does not diagnose, treat, cure, or prevent disease and does not provide emergency medical services.

Information concerning exercise, food, calories, macronutrients, workouts, weight, AI-generated information, step counts, goals, or other fitness and wellness subjects is provided for informational and fitness purposes.

You should seek appropriate professional advice before beginning or materially changing an exercise, nutrition, weight-management, or wellness program where appropriate to your circumstances.

If you believe you are experiencing a medical emergency, contact the appropriate emergency service.

Do not use Macro Pump, Pump Buddy, or Coach Mode as an emergency service.

30.4 Fitness and Nutrition Information May Be Inaccurate

Nutrition, calorie, food, exercise, workout, portion-size, energy, and related information may be obtained from external databases, public sources, artificial intelligence, users, manufacturers, restaurants, coaches, or other third parties.

Such information may be inaccurate, outdated, estimated, incomplete, mislabeled, or unsuitable for a particular person.

Macro Pump does not guarantee the accuracy of:

You remain responsible for evaluating information before relying upon it.

30.5 Pump Buddy and Artificial Intelligence

Pump Buddy uses artificial intelligence, including Google's Gemini technology.

Artificial-intelligence systems can generate incorrect, incomplete, outdated, misleading, or inappropriate responses, including responses that appear confident despite being incorrect.

Pump Buddy is not a doctor, registered dietitian, medical professional, or emergency service.

You are responsible for reviewing an AI-generated suggestion before relying upon or confirming it.

Where Pump Buddy proposes an action affecting your Macro Pump information, Macro Pump may require confirmation before performing that action.

Use of Pump Buddy may involve disclosure of information to Google as explained in the Privacy Policy and applicable in-app consent process.

You may choose not to use Pump Buddy.

30.6 Your Account

You are responsible for maintaining control of your device and your Apple or Google authentication account.

You must not permit another person to impersonate you through Macro Pump.

You must provide information that is truthful where accuracy is necessary to use the feature.

You must promptly notify Macro Pump if you reasonably believe your account has been compromised.

30.7 Apple Health

If you authorize Apple Health integration, Macro Pump may read the HealthKit data specifically described in the applicable permission request and Privacy Policy.

You control HealthKit authorization through Apple.

HealthKit information will not be used for advertising or sold to data brokers.

Where HealthKit-derived step information is disclosed to a connected coach, the client's acceptance of that coach's connection request is the required authorization — see the Privacy Policy, Section 25.

30.8 Coach Mode

Macro Pump provides technology that allows certain users to present themselves as coaches and allows users to choose whether to connect with them.

A coach is an independent user of the platform unless Macro Pump expressly enters into a separate written agreement stating otherwise.

A coach is not an employee, agent, representative, partner, healthcare provider, franchisee, or spokesperson of Macro Pump merely because the individual uses Coach Mode.

Macro Pump does not supervise the day-to-day conduct or professional services of independent coaches.

30.9 Coach Document Badge — Extremely Important

A coach may submit documents that the coach claims relate to personal training, fitness education, professional certification, licensing, qualifications, or similar matters.

Macro Pump may display a badge, checkmark, icon, symbol, designation, or profile indicator after such documentation has been submitted.

The badge means only that documents were submitted.

Any such badge means only that Macro Pump received one or more documents from the coach.

It does not mean that Macro Pump has independently verified the coach or the documents.

Macro Pump does not represent or warrant that:

Macro Pump does not undertake independent credential authentication merely because a document was uploaded.

Macro Pump does not undertake to contact certification organizations, licensing authorities, employers, educational institutions, insurers, references, governments, or other entities to independently establish the accuracy of submitted information unless Macro Pump expressly states otherwise in a separate written verification program.

A submitted document may be inaccurate, altered, expired, invalid, misleading, fraudulent, forged, stolen, or otherwise unreliable.

30.10 The Badge Is Not an Endorsement

A badge, checkmark, document-submission indicator, Coach Mode status, or presence on Macro Pump does not constitute:

Macro Pump does not guarantee any coach's identity, qualifications, credentials, certification, education, experience, competence, conduct, safety, services, recommendations, results, professional standing, or legal authorization to practice.

30.11 User Responsibility for Choosing a Coach

The decision to connect with, communicate with, hire, pay, meet, rely upon, receive services from, or follow instructions from a coach is the user's own decision.

Users are responsible for independently evaluating a coach before relying on them.

A user who considers a coach's credentials important should independently verify those credentials with the appropriate issuing body, licensing authority, certification organization, professional registry, insurer, or other source.

You should not rely solely on:

when deciding whether the coach is appropriate for you.

To the maximum extent permitted by applicable law, Macro Pump is not responsible for the independent acts, omissions, advice, conduct, representations, credential claims, professional services, or interpersonal conduct of a coach solely because that person uses the Macro Pump platform.

Nothing in these Terms eliminates a duty or liability of Macro Pump that applicable law does not permit Macro Pump to exclude.

30.12 Coach Responsibilities and Representations

A user using Coach Mode is solely responsible for the truthfulness and legality of information and documents they provide.

Each coach represents and warrants that:

Submitting fraudulent or intentionally misleading credential information constitutes a material breach of these Terms.

Macro Pump may remove a badge, suspend Coach Mode, restrict an account, terminate an account, preserve records, or take other reasonable action if Macro Pump suspects credential fraud, impersonation, abuse, safety concerns, or violation of these Terms.

Macro Pump's right to take such action does not create a general duty to monitor, investigate, or independently verify every coach.

30.13 Coaches Are Responsible for Their Services

Coaches are responsible for the services, advice, workouts, communications, representations, and conduct they provide.

A coach is responsible for determining whether the coach is legally permitted and professionally qualified to provide the relevant service.

Macro Pump does not authorize a coach to:

Any coaching agreement independently formed between a user and coach is between those parties unless Macro Pump expressly agrees otherwise in writing.

30.14 Coach-Client Disputes

Unless applicable law provides otherwise, disputes relating to a coach's independent:

are primarily disputes between the coach and client.

Macro Pump may provide reporting, blocking, disconnection, suspension, or other platform safety functionality but does not become a party to a coach-client agreement merely by providing those tools.

30.15 Reporting Coach Misconduct

Users should report suspected fraudulent credentials, impersonation, abuse, threats, dangerous conduct, or other serious violations to mymacropump@gmail.com or through applicable in-app reporting functionality.

Macro Pump may investigate and take action where reasonably appropriate.

A decision to investigate, remove, retain, restrict, or restore an account does not constitute a professional finding regarding a coach's credentials or competence.

30.16 Coach-Client Data

Coaches may gain access to client information only through functionality permitted by Macro Pump and subject to applicable authorization.

Coaches must use client information solely for lawful and authorized coaching purposes.

Coaches must not:

Coaches are independently responsible for complying with privacy, confidentiality, professional, and data-protection obligations that legally apply to them.

30.17 Coach Private Notes

Macro Pump may permit coaches to maintain private notes concerning clients.

Those notes are intended for legitimate coaching purposes.

A coach must not intentionally include unlawful, discriminatory, defamatory, malicious, or irrelevant information in private notes.

The fact that notes are not ordinarily visible through the client interface does not override privacy rights that may exist under applicable law.

30.18 User Content

You retain ownership of content you own and submit to Macro Pump.

You grant Macro Pump a limited, non-exclusive, worldwide licence to host, store, reproduce, process, transmit, resize, format, and otherwise use your submitted content as reasonably necessary to:

This licence does not authorize Macro Pump to sell your private health or fitness information for advertising.

You represent that you have the right to submit information and content you provide.

30.19 Prohibited Conduct

You may not use Macro Pump to:

30.20 Subscriptions and App Store Billing

Macro Pump may offer auto-renewable subscriptions through Apple's App Store.

The applicable purchase interface will disclose:

Apple processes App Store payments.

Macro Pump does not directly control Apple's payment authorization, billing systems, taxes, refund decisions, subscription-management interface, or Apple account.

Subscriptions may automatically renew unless cancelled in accordance with Apple's applicable subscription rules.

Users can manage applicable subscriptions through their Apple account.

Deleting a Macro Pump account does not necessarily cancel an Apple subscription.

Nothing in these Terms removes mandatory refund or consumer rights provided by applicable law.

30.21 Third-Party Services

Macro Pump depends on third-party systems and providers.

These may include Apple, Google, Supabase, DigitalOcean, nutrition databases, exercise databases, and other infrastructure or information providers.

Third-party systems may experience downtime, errors, data changes, service limitations, or policy changes outside Macro Pump's reasonable control.

Applicable third-party terms may also apply.

30.22 Intellectual Property

Macro Pump and its original software, interface, branding, trademarks, graphics, designs, documentation, code, and proprietary content are owned by or licensed to Six Side Marketing and are protected by applicable intellectual-property laws.

These Terms do not transfer ownership of Macro Pump intellectual property to you.

30.23 Licence to Use the Application

Subject to these Terms, Macro Pump grants you a limited, personal, non-exclusive, non-transferable, revocable licence to use Macro Pump on Apple-branded products that you own or control as permitted by Apple's applicable usage rules.

Macro Pump is licensed, not sold.

30.24 Service Availability

Macro Pump does not guarantee uninterrupted or error-free availability.

Services may be affected by:

30.25 Account Suspension and Termination

Macro Pump may reasonably restrict, suspend, or terminate an account in response to:

Where required by law, applicable notice or remedies will be provided.

30.26 Account Deletion

Users may initiate account deletion through Macro Pump's in-app account/privacy settings.

Deleting the app itself does not delete an account.

Deleting an account does not necessarily cancel an Apple subscription.

Data deletion is further described in the Privacy Policy.

30.27 Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MACRO PUMP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

MACRO PUMP DOES NOT GUARANTEE:

Nothing in these Terms excludes a warranty, remedy, or consumer right that applicable law does not permit Macro Pump to exclude.

30.28 Assumption of Fitness and Coaching Risks

Physical exercise involves inherent risk.

Users are responsible for considering their own abilities and circumstances before participating in exercise.

Working with an independent coach may involve personal, physical, financial, or interpersonal risks.

Macro Pump cannot guarantee that a particular exercise, nutrition approach, coach, or coaching relationship is suitable for you.

Use reasonable judgment and obtain professional medical or other qualified advice where appropriate.

30.29 Limitation of Liability

To the maximum extent permitted by applicable law, Six Side Marketing, Macro Pump, and their officers, directors, employees, contractors, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to Macro Pump.

This may include loss arising from:

To the maximum extent permitted by applicable law, the aggregate liability of Macro Pump arising from or relating to the service will not exceed the greater of:

(a) CAD $100; or
(b) the amount you actually paid directly for Macro Pump services during the twelve months immediately preceding the event giving rise to the claim.

This limitation does not apply where applicable law prohibits the limitation, including where liability cannot legally be excluded or limited.

Nothing in these Terms limits mandatory consumer, privacy, product-liability, or other rights that cannot lawfully be waived.

30.30 Coach Indemnification

To the maximum extent permitted by applicable law, a person using Coach Mode agrees to defend, indemnify, and hold harmless Six Side Marketing, Macro Pump, and their officers, directors, employees, and contractors from third-party claims, damages, liabilities, losses, judgments, penalties, and reasonable legal costs arising from that coach's:

This section does not require indemnification for liability that applicable law prohibits Macro Pump from shifting to another party.

30.31 Privacy

Use of Macro Pump is subject to the Macro Pump Privacy Policy.

Specific features may require additional permissions or express consent, including HealthKit access, coach sharing, photographs, and third-party artificial-intelligence processing.

30.32 Governing Law

Unless mandatory law requires otherwise, these Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Mandatory consumer and privacy rights applicable in a user's jurisdiction remain unaffected.

30.33 Apple-Specific Terms

These Terms are between you and Six Side Marketing, not Apple Inc. ("Apple").

Six Side Marketing, not Apple, is solely responsible for Macro Pump and its content.

Apple has no obligation to provide maintenance or support services for Macro Pump.

To the extent Macro Pump fails to conform to an applicable warranty and Apple's applicable rules provide a remedy, you may notify Apple, and Apple may refund the applicable purchase price for the application, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation regarding Macro Pump.

Six Side Marketing, not Apple, is responsible for addressing claims relating to Macro Pump or possession or use of Macro Pump, including:

If a third party claims that Macro Pump or your possession and use of Macro Pump infringes that party's intellectual-property rights, Six Side Marketing, not Apple, is responsible for investigation, defence, settlement, and discharge of the claim to the extent required by applicable law.

You represent and warrant that you are not located in a country or region subject to a United States government embargo or designated by the United States government as supporting terrorism and that you are not listed on an applicable United States government prohibited- or restricted-party list.

You must comply with applicable third-party terms when using Macro Pump.

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms.

Upon your acceptance of these Terms, Apple has the right to enforce the Apple-specific provisions against you as a third-party beneficiary.

30.35 Changes to These Terms

Macro Pump may update these Terms to reflect changes to the service, technology, applicable law, subscriptions, security requirements, or business practices.

Where legally required, Macro Pump will provide appropriate notice of material changes.

A material change will not retroactively remove legal rights that cannot lawfully be removed.

30.36 Severability

If a provision of these Terms is held invalid or unenforceable, it will be interpreted, limited, or severed to the minimum extent necessary, and the remaining provisions will continue in effect unless applicable law requires otherwise.

30.37 No Waiver

Failure by Macro Pump to enforce a provision on one occasion does not waive the right to enforce that provision later.
